0 – Definitions
FRANCOFAUNE : Association governed by the French law 1901 organizing the event FAUNTASTIC.
FAUNTASTIC : Name of the event organized by the association FRANCOFAUNE.
USER : The user title relates to anyone browsing our website free of charge, be it anonymously or not.
NON-MEMBER : The non-member title relates to any user browsing our website free of charge, anonymously and without obligation of registration on the website.
MEMBER : The member title relates to any user browsing our website free of charge, non-anonymously and registered on the website. It includes people that have ordered physical goods delivered to the domicile of the member who made the order.
ATTENDEE : An attendee is a member who confirmed their attendance at the event by paying the invoice in its entirety.
GOODS : Physical goods for sale on the website of the FAUNTASTIC event.
SERVICE : The service mentioned in relates mainly to the housing offer in a hotel Residence that can include meals or other services
1 – Preamble
These conditions are addressed to a consumer who has full legal capacity in their country of residence. This contract is subject to French law. Any dispute arising in the context of the application or interpretation of this contract will be submitted to the competent French courts. In the event of a dispute, an amicable solution will be sought in priority to any legal action.
The European Commission has put up an online platform for resolving disputes to collect your possible complaints in order to transmit them to the competent national mediators.

These Terms of Sale and Use are intended to define the terms under which FRANCOFAUNE provides services to the USERS through its website FAUNTASTIC. Any use of the services offered by FRANCOFAUNE must respect these Terms of Sale and Use.
On the website consisting of all services available at the URL https://fauntastic.eu including websites and all its internal branches, will be presented all the essential characteristics of the products.
The general structure of the FAUNTASTIC website as well as the texts, graphics, images, sounds and videos composing it, are the property of the publisher or its partners. Any representation and / or reproduction and / or partial or total exploitation of the contents and services offered by the website, by any means whatsoever, without the prior written authorization of an Administrator of the website is strictly prohibited and could constitute an infringement according to the Articles L.335-2 and L.122-5 of the Intellectual Property Code.
Access to the entire public frontend of the FAUNTASTIC website is free, without obligation to purchase. FRANCOFAUNE reserves the right to modify without notice or announcement the present general conditions which have to be consulted before any procedure with FAUNTASTIC. The USER must be of age or have an authorization from their legal guardian before making a purchase from FRANCOFAUNE. Any connection to the website is subject to compliance with these conditions and acceptance by the USER.
If any of the clauses or provisions of these General Conditions of Sale and Use were to be annulled or declared illegal by a final court decision, this nullity or illegality will not affect the other clauses and provisions, which will continue to apply.
Any ambiguity as to the interpretation of these General Conditions of Sale and Use should not be interpreted to the detriment of the writing party.
2 – Intellectual Property Rights
The USER acknowledges that FRANCOFAUNE is the sole owner of the Intellectual Property Rights present on all the services provided. Nothing in these Terms and Conditions of Sale and Use shall be construed as conferring to the USER a license on Intellectual Property Rights, which FRANCOFAUNE may have the property or the exclusive right of exploitation. FRANCOFAUNE only grants an authorization to display its content in a personal and private capacity, to the exclusion of any public viewing or distribution. Therefore, any representation, reproduction or extraction not previously allowed by FRANCOFAUNE of the content or its website and any other Intellectual Property Rights is strictly prohibited under penalty of legal proceedings. The offender is liable to civil and criminal penalties, including the penalties provided for in Articles L. 335.2 and L. 343.1 of the Intellectual Property Code.
FRANCOFAUNE undertakes and guarantees that it has all the necessary rights to design, manufacture, produce or sell the goods. In particular, FRANCOFAUNE undertakes and guarantees that it is the sole holder of the intellectual property rights relating to the goods produced and that these goods, their design, manufacture, realization, offers for sale, sale, commercialization do not infringe the rights intellectual property rights of third parties (counterfeit products and / or projects).

3 – Conditions of Sale and Use
The USER declares having read and accepted expressly and unconditionally these Terms and Conditions of Sale and Use in effect on the day of access to the website proposed by FRANCOFAUNE.
FRANCOFAUNE reserves the right, at its sole discretion, to update, modify or replace any part and at any time these Terms and Conditions of Sale and Use. It is therefore the responsibility of the USER to regularly refer to the latest version of the General Conditions of Sale and Use permanently available on the FAUNTASTIC website.
You can consult the most recent version of the Terms of Sale and Use at any time on this page.
Any use of the services after modification of the General Conditions of Sale and Use, is pure and simple acceptance by the USER of the new General Conditions of Sale and Use. The USER expressly acknowledges that they must be discerning in the use of the content and bear all risks associated with it, and particularly when relying on the timeliness, usefulness or completeness of this content, and carry out any verification under their responsibility.
4 - The methods of archiving and access to the contract
An archiving of the purchases is carried out on a reliable and durable support.
Any validated order constitutes an irrevocable acceptance of the General Conditions of Sale and Use and the payment. The data recorded by FRANCOFAUNE during the order constitute the proof of all transactions made between FRANCOFAUNE and the MEMBERS. The data recorded by the banking institution is the proof of financial transactions.
5 – Responsibility
FRANCOFAUNE acknowledges and agrees to be solely responsible for the proper performance of these terms and conditions and the obligations incumbent on it under the contract concluded with the MEMBER. Nevertheless, the responsibility of FRANCOFAUNE cannot be committed because of a fortuitous event, related either to the MEMBER, the unpredictable and insurmountable fact of a third party to the contract, or to a case of absolute necessity, in accordance with Article L. 221-15 of the Consumer Code.
6 – Generalities
The MEMBER commits themselves to have the full legal capacity to engage under the present General Conditions of Sale and Use and to conclude contracts in order to obtain the ATTENDEE status.
FRANCOFAUNE commits itself and guarantees to have the full legal capacity to engage under the present General Conditions of Sale and Use in order to conclude contracts. FRANCOFAUNE also commits itself to respect the laws and regulations in force relating to its activity.
FRANCOFAUNE commits itself to provide accurate and complete information as to the identity of its legal representative, their contact details including their surname, first name, email address, postal address and his activity. FRANCOFAUNE also commits itself if necessary, to update this information.
The MEMBER commits themselves to provide accurate and complete information as to their identity and contact information, including his surname, first name, e-mail address and postal address. The ATTENDEE also undertakes, if necessary, to update these informations.
The MEMBER recognizes and expressly agrees that their email address will be used for any information exchange, conclusion and execution of contracts with FRANCOFAUNE. As such, they undertake to provide an effective email address and to consult their e-mail inbox throughout the conclusion and execution of said contracts.
FRANCOFAUNE commits itself to provide delivery times for goods and services electronically in accordance with Article L.111-1 of the Consumer Code.
FRANCOFAUNE commits itself to inform the MEMBER by email of any delay in the realization of the goods or services ordered.
Upon registering for the event, the MEMBER will receive a unique registration number, this number permits the identification of the ATTENDEE and access to the details of their order. The registration numbers will also make it possible to do check-ups at the place of the event, to ensure their access to the event and to give them the goods or services purchased. The ATTENDEE must therefore be provided with an official identity document, valid and with photo (ID card, passport, driver's license or residence card) to present to FRANCOFAUNE registration team.
The acquisition of a ticket implies adherence to the rules of procedure of the ticket of the event. The ATTENDEE will strictly comply with the rules of FRANCOFAUNE as well as with its General Terms and Conditions of Use at the risk of being held liable.
There may be information on the FAUNTASTIC website or in communication services that may contain typographical errors, inaccuracies or omissions. These could be related to product descriptions, prices, promotions, offers, fees and availability.
FRANCOFAUNE reserves the right to correct any error, inaccuracy, omission, and to change or update information or cancel orders, if any information on the site FAUNTASTIC or on the communication services was to be erroneous or missing at any time and without notice (including after you have placed your order).
You agree to indemnify, defend and protect FRANCOFAUNE, its partners, managers, service providers, subcontractors, suppliers and members, with respect to any claim or demand, including reasonable attorney fees, made by any third party to cause of or arising from your violation of these Terms of Sale and Use or the documents to which they refer, or your violation of any law or rights of a third party.
7 – Pricing / Rates
The characteristics of the products and services offered for sale are presented on the website (https://fauntastic.eu/) in € (Euros) all (French) taxes included, other taxes may be applicable on the day of the order (any change of VAT rate will automatically be reflected in the price of the products).
The prices include the order processing fees.
Prices may vary depending on the time without notice. These changes will however be announced in advance, it is up to the USER to follow the news of the site.
No rebate requests will be granted once the price has been re-evaluated (does not apply to MEMBERS and ATTENDEES who have already paid all or part of their current order during the re-pricing).
8 – After sales service

When writing the e-mail, please provide the order number / invoice number associated with the good or service in question.
9 - Right of withdrawal
Although the law authorizes us to refuse all refund requests for services "of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities that must be provided on a specific date or period "in accordance with Article L221-28 of the French Consumer Code, we grant 14 grace days for retraction requests following the first payment. A partial refund will be sent to you (see section "Refund Terms"). After this period, no refund will be granted.
This right of withdrawal must be exercised by message to the contact e-mail address. Once the case is taken care of, the MEMBER or ATTENDEE will receive a form to fill out and return dated and signed to the same e-mail address. The latter entitles the ATTENDEES to the refund of sums already paid within 14 days of the receipt of the first payment. Any request for retraction that does not meet the legal deadline or does not provide enough information will not be taken into consideration.
The MEMBER or ATTENDEE acknowledges and accepts that they no longer have the right of withdrawal 50 days before the start of events.
Delivery of physical goods only (ordered on the website and sent to the physical address of the MEMBER):
In accordance with Articles L121-21 and L221-18 of the Consumer Code, the MEMBER who has placed an order for physical goods has the legal period of 14 days to exercise their right of withdrawal. Any request for retraction that does not meet the legal deadline or does not provide enough information will not be taken into consideration.
The MEMBER will then have 14 days to return at their expense (with parcel tracking number) the goods they received, from the date of sending their withdrawal form and will receive their refund (including the costs of initial delivery) in the same period.
10 – Orders
The MEMBER commits themselves to pay for the goods and services ordered.
As part of the payment via the bank transfer solution, the MEMBER commits themselves and guarantees to have the necessary authorizations to use this method of payment.
FRANCOFAUNE commits itself to honor any order within the timeframe for completion of the ordered goods and services that it has provided. However, FRANCOFAUNE may refuse an order if it has passed abnormally or in bad faith or for any other legitimate reason, and in particular, when there is a dispute with the MEMBER regarding the payment of a previous order.
Process for ordering a custom product is as follows:
- The MEMBER makes an online registration request.
- After having chosen their options and filled in the required information of the forms for their registration, they can then choose the items they will add to their basket, then validate it. Their order is then edited and the amount of this order indicated.
- From this moment, the MEMBER must choose their payment method:
- By card, here all the sum must be paid under 15 minutes.
- By bank transfer, the MEMBER has 15 days from the date of the validation of their order to pay their order in full or make a first transfer of 100 € (Euros) per bought ticket, as part of the purchase of ticket to participate in the FAUNTASTIC event. Then if applicable to settle their order within 45 days from the day of the validation of their order, indicating their order number in each transfer.
- Once the balance of the order has been settled, the MEMBER receives a detailed invoice electronically (as well as a confirmation of their registration for the FAUNTASTIC event if they have purchased a ticket).
Upon confirmation of money receipt, the MEMBER will receive an order confirmation e-mail with a detailed invoice.
As part of the purchase of a ticket for the FAUNTASTIC event, the MEMBER once the totality of the payments paid by the latter and thus their participation validated (title of ATTENDEE), they will sign a temporary membership to the FRANCOFAUNE association at the place of the event for the duration of the event. This will allow them to enjoy all the private benefits of the event.
Certain products or services may be exclusively available online on the FAUNTASTIC website. These products or services may be available in limited quantities.
FRANCOFAUNE reserves the right, but is not obliged to do so, to limit the sales of the products or services to any person, and in any geographical region or jurisdiction. FRANCOFAUNE may exercise this right on a case-by-case basis. FRANCOFAUNE reserves the right to limit the quantities of any product or service offered. All product descriptions and product prices are subject to change at any time without notice, in our sole discretion. FRANCOFAUNE reserves the right to stop offering a product at any time.
FRANCOFAUNE reserves the right to refuse any order placed on the site.
The MEMBER is informed, in real time, when placing their order, the availability of goods and services desired.
In the event of unavailability of all or part of the goods or services desired by the MEMBER in the indicated category, alternative solutions will be proposed to them after having warned them, and subject to the availability of said alternatives in this other category.
11 – Payment
FOR THE FAUNTASTIC EVENT ALL PAYMENTS MUST BE PAID IN THEIR ENTIRETY NO LATER THAN 30 DAYS BEFORE THE START OF THE EVENT.
The payment by the MEMBER is carried out on the site either by credit card or by bank transfer on the bank account ID communicated by FRANCOFAUNE.
Thus, the MEMBER acknowledges and agrees that the payment will be made as follows:
- By credit card, the full amount must be paid within 15 minutes. If this sum is not paid within 15 minutes, the basket will be reset and the MEMBER will have to start again.
- The MEMBER may pay the total price in a single payment (bank transfer) after registration.
- The MEMBER may also pay the invoice in several installments if it concerns the purchase of a ticket for the FAUNTASTIC event:
- The MEMBER will have to pay a first deposit (said payment A) within 15 days from the date of registration. This first payment serves as a credit to enable FRANCOFAUNE to take the necessary steps with our partner hotel. This amount must be 100 Euros (€) per bought ticket.
- If the MEMBER fails to make payment A during the 15 days following the registration date, they will receive a reminder by e-mail. On receipt of this email, they will have 7 days to make the first payment or the full payment. If the MEMBER still fails to pay, their participation will simply be canceled at no additional cost.
- Once the first payment has been received, the MEMBER will have 45 days from registration to make the second payment. If the MEMBER has not manifested themselves, they will receive a reminder inviting them to pay the sum within 7 days.
- The second payment (payment B) must cover the remainder of the total sum and must be made within 45 days from the date of registration. If the MEMBER does not pay the totality of the amount before the deadline, they are exposed to 2 reminders. If the MEMBER still fails to pay, their participation will be cancelled as well as their membership to the association.
If the MEMBER still fails to make the payment within 7 days of the first payment B reminder, they will receive a new reminder email inviting them again to pay within 7 days. If the MEMBER still fails to pay, their participation will be canceled and the sums already paid will not be refunded. (See refund terms)
The MEMBER acknowledges and agrees that the validation of the payment constitutes a payment order.
No discount will be granted in case of advance payment.
12 – Refund Terms
The exercise of the right of withdrawal must be made no later than 14 days after the initial payment of the order. It gives right to a refund of all or part of the sums paid during the order as soon as possible and at the latest 14 days from the date on which you exercised this right. The refund will be made by bank transfer on the method of payment attached to the one used during the purchase.
For purchases related to the FAUNTASTIC event, expenses being incurred with our partners, the MEMBER or ATTENDEE would be charged € 35 on its reimbursement. After this period, no refund will be granted.
If a MEMBER fails to pay in several installments by transfer (payment B), the latter will not be refunded.
In case of definitive cancellation of the event, the reimbursement of the participation price will only be made in favor of the original purchaser. In addition, requests for reimbursement must, to be admissible, be accompanied by an updated bank account and be formulated within a maximum period of 2 months following the cancellation of the event. Any application that does not meet these conditions will be rejected.
13 – Personal Data
Personal information: "information that allows, in any form whatsoever, directly or indirectly, the identification of natural persons to which they apply" (Article 4 of Law No. 78-17 of 6 January 1978).
In France, personal data is notably protected by the law n ° 78-17 of January 6th, 1978, the law n ° 2004-801 of August 6th, 2004, the article L. 226-13 of the Penal Code and the European Directive of the October 24, 1995.
In accordance with the provisions of articles 38 and following of the law 78-17 of January 6th, 1978 relative to the computing, the files and the liberties, every USER has a right of access, rectification and opposition to the personal data concerning them, by making their written and signed request, accompanied by a copy of the identity document with signature of the holder of the document, specifying the address to which the answer must be sent.
The databases are protected by the provisions of the Act of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.
FRANCOFAUNE commits itself not to use the personal data of MEMBERS and ATTENDEES for other purposes than the processing of the order with direct partners (hotels), billing, monitoring the relationship with it or possible litigation and in particular to only insert advertising for itself in any form whatsoever in its communications with them.

FRANCOFAUNE commits itself via its website FAUNTASTIC.EU to comply with the regulations in force applicable to the processing of personal data and in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 applicable from 25 May 2018 (hereinafter "the European Data Protection Regulation" or GDPR).
The consultation of the website does not require registration or prior identification. It can be done without you communicating personal data about you (surname, first name, address, etc.). FRANCOFAUNE does not register any personal data for the simple consultation of the website.
We may change this policy from time to time to reflect changes in our practices, to further refine our practices, or to ensure regulatory compliance. In this case, you will be informed by a message (pop-up) on the FAUNTASTIC website (or by e-mail if you are a MEMBER) inviting you to consult the updated policy.

All these data are processed in order to allow the MEMBER:

- Access their profile and their orders
- Consult the follow-up of their orders

- To solicit us in relation to the ordered products
- Data on diets and allow us to make the necessary requests to the partners to meet the needs of each during the conventions
- The data on the willingness to come in fursuit will allow us to evaluate what space will be needed dedicated to it in the conventions
- The data on public transport will allow us to propose possible routes and schedules for shuttles
- Bank details are only used for online payment of purchased products
The finalities of FRANCOFAUNE processing these informations are the e-mail contact and the e-mail alert to provide the necessary information for the proper execution of the services, the products delivery, the follow-up of the requests and orders, the withdrawal or modifications requests. All nominative data will be used to manage the contractual part between the MEMBER or ATTENDEE, the FRANCOFAUNE association and the direct partners to organize the event. Nominative data will be provided to our direct partners (hotel, restaurant, etc) to best meet the needs of each and ensure FRANCOFAUNE against any individual degradation.
Newsletters :
These data correspond to the data provided during the registration to one or more newsletters from our site: e-mail, username, surname and first names.
- All these data are processed in order to allow the MEMBER:
- To be contacted by our services using communication tools
- To be kept informed of the latest news of the convention
- Being kept informed of the latest products available
This personal data may also be used by FRANCOFAUNE for promotional or event information.
Right of access and rectification
In accordance with the law "Informatique et Libertés" of January 6, 1978 amended by the law of August 6, 2004, the user has the right to access, modify information about them. Customers and members of FRANCOFAUNE have the right to access and correct data concerning them.
You have a right to information, rectification and modification of your personal data. To do this, simply access your profile to edit your personal information. Periods of conservation
The personal data quoted above are kept as long as necessary for the processing of orders including the guarantee. These data will be kept for a maximum of 12 months. The data will then be deleted from the site and for any billing archived in a physical way for 5 to 10 years depending on the nature of the document.

- An SSL certificate has been put in place to ensure the confidentiality of the data circulating between the customer and our infrastructure.
- Also, a strong password policy has been put in place to prevent unauthorized access.
- On some of our services it will also be possible to use a dual authentication system called 2FA.

Dealer's Den terms and Conditions
Article 1 – General: Fauntastic Night of the Yokai organized by the Association FRANCOFAUNE will take place from April 2 to 5, 2021 at the Golden Tulip Lyon/Saint Priest (69791). The organisational arrangements shall be determined and may be modified at the initiative of the organiser. In case of force majeure (terrorist threat, natural disaster, etc.), the organiser reserves the right to cancel the event.
Fauntastic is a private event for professional artists, associations and individuals. To individuals, in the exclusive context of the sale of their personal property and on an exceptional basis.
The organiser reserves the right to refuse any artists whose activity does not appear to be in conformity with the activity of the event or any exhibitor’s candidacy which could compromise the smooth running of the event, without any consideration being sought.
Dealer’s Den will take place from April 3 to 4, 2021 from 10am to 12am with a breaktime for artists until re-opening from 1pm to 4pm.
Article 2 – Participation: Dealers will ensure that they are in compliance with applicable legislation and provide the necessary information and documentation to the organizers:
- The completed Registration Form
- Being a Resident during the event
The possibility of obtaining a stand is done on selection, the organizer undertakes to make the selection in an impartial manner, and to distribute artists with a goal of diversity for the event.
Article 3 – Insurance & Safety: The Francofaune Association disclaims any liability with Dealers for their legal and tax situation, as well as for the risks of theft, losses, accidents, deterioration and fires, etc. The stands will be the sole responsibility of dealers.
Exhibitors can leave their belongings and merchandise in the Dealer’s Den room overnight from Saturday to Sunday. The Hall will be locked, keys under the supervision of the convention staff.
All exhibitors undertake to take out civil liability insurance for the entire duration of the event, to insure their companions and their property for any damage likely to be caused by a third party.
For safety reasons, the materials used will conform to M1 standards. This is why the organizer is committed to providing flame retardant fabric for the stands.
Article 4 – Assembly & Disassembly: Dealers installation will be done 1h before opening to the public.
Saturday 3 and Sunday 4 April -
The installation will begin on Saturday 3 at 9am.
As a reminder, the table dimensions are 160x80cm for a full stand and 80x80cm for a half stand.
Unoccupied stands at the opening of the Dealers Den will be considered available and will become the property of the organizer who will be able to dispose of them without the absent person being able to claim any compensation. The organiser may also decide to place a new artist if no attendance.
At the disassembly on Sunday, April 4, starting at 4pm, exhibitors are required to leave their stands clean and use the garbage bags available to them. They will be held responsible for damage to the furniture, floors and walls of their stands.
Article 5 – Commitments: Exhibitors undertake to personally occupy their stands. Any partial or total subscription or assignment to a third party is prohibited without the prior authorisation of the organizer.
Dealers may, with the agreement of the organizers, distribute or make available to visitors, flyers or other products promoting another event or shop.
For the well-being of all, beware of the use of sound or music, the freedom of some stops where the freedom of others begins!
Article 6 – Goodies: Any person engaged in the practice of trafficking, counterfeiting, or committing offences similar or similar to this is liable to penalties provided for in Articles 321-1 to 321-8, R-633 and R535-7 of the new Penal Code.
However, artists are allowed to sell their creations under the right to caricature, We also allow them to inquire about the licences authorized to operate or to request a partial assignment of rights from them.
Items and goodies 16+ and 18+ will need to be sealed in a binder or other means of concealment, exhibitors will be asked to post content on them for visitors.
Article 7 – Provision of Services: The organizers and the Francofaune Association will not be held responsible for any exchange of services between the exhibitor and the visitor.
If an agreement is not respected between the exhibitor and the visitor, they shall settle their dispute among themselves or by any other legal means.
Article 8 – Cancellation: Cancellations are possible, but please notify the organizer as soon as possible so that the organizer can find a replacement.
Article 9 – Visitors: Every visitor undertakes to comply with these rules when attending the Dealers Den event:
- No photographs or videos of stands and artists without their agreements and in respect of the copyright and authorship of the works.
- No drinks, they will be kept during this time at the Dealers Den reception and can be picked up after the visitor’s turn.
- No bags, this to avoid any damage or theft, they will also be kept if the visitor cannot leave it elsewhere, at the reception, under surveillance.
- No “Fursuits” or any other imposing costume/object in the Dealers Den location, the costumes taking up a lot of space and often causing a mass stop of other visitors, they can prevent traffic, the promotion of exhibitors and causing damage to the stands by inadvertently while moving and walking.
- Respect and courtesy between visitors/visitors and visitors/exhibitors. Any unwelcome behaviour may be reported and the offender kicked out the Dealers Den place.
Article 10 – The organizer: The organizer undertakes to provide exhibitors with several services outside their stand.
- A reception stand for any questions/information/flyer/other
- A photograph of their stand after editing for the promotion of the artist and the event
- Fire retardant fabric on stand
- A Plastic Laminator
- A Glue Gun
- plugs/extensions
- Water pots for painting
- Beverages & Snacks (Vegan)
Article 11 – Application of the Regulations: Any breach of these Regulations may result in the suspension of the exhibitor from the partial or final event.
The registration form and the signature of this document commit Dealers to the total acceptance of these Rules.
Visitor regulations will be posted at the entrance of the Dealers Den.
